Terms of Sales & Services

These Terms of Service and Sales Agreement, ("Agreement") govern all photography services, digital image purchases, print orders, and related transactions provided by Mike Norton Photography LLC ("Photographer"). By booking a session, accessing an image gallery, downloading photographs, or completing a purchase, you ("Client") acknowledge that you have read, understood, and agree to the following terms.

1. Services & Orders

   Mike Norton Photography LLC provides photography services including but not limited to adventure dog photography, dog & people photography, and event or race coverage.

   All photography services, digital downloads, and print products are considered custom goods. By placing an order or booking a session, Client confirms that all selections and purchases are final.

   The Photographer reserves the right to refuse or discontinue services at their discretion if conditions become unsafe, unlawful, or disruptive.

2. Booking & Payment terms

   Session bookings may require a non-refundable retainer to reserve a date. Remaining balances must be paid prior to session unless otherwise agreed in writing.

   For image and print purchases, payment is due in full at time of purchase.

   Prices are subject to change at any time without notice, except for confirmed bookings or completed orders.

   Failure to submit payment may result in cancellation of services or withholdings of image delivery.

3. Payment Processing

   Payments are securely processed through third-party payment processors including Stripe and/ or Pay pal.

   Mike Norton Photography LLC does not collect, process, or store credit card or banking information. All financial information is handled directly by payment processor in accordance with their security policies.

   By completing a purchase, Client also agrees to terms and policies of the selected payment processor.

4. Chargebacks & Payment Disputes

   Client agrees not to initiate a chargeback or payment dispute with their bank or payment provider without first contacting Mike Norton Photography LLC in writing to attempt resolution.

   In the event of chargeback or reversed payment:

   • Any license granted for image is immediately revoked.

   • Client must cease all use of photographs.

   • Photographer reserves the right to invoice Client for the full balanced owed, including chargeback fees, payment processor penalties, collection costs, and administrative expenses.

   Downloading images, accessing an online gallery, or using delivered photographs constitutes acceptance of services rendered and completion of the transaction.

5. Refund Policy

   • All sales are final.

   • Digital image purchases are non-refundable once delivered.

   • Print and product orders cannot be modified or canceled once submitted to the professional lab.

   • Third party disclaimer: Mike Norton Photography LLC is not liable for the actions, delays, or errors of third-party vendors, including print labs and shipping carriers.

   • While we partner with elite professional labs to ensure the highest quality, please note that ( Mike Norton Photography LLC) is not liable for damages occurring during manufacturing or transit. In the rare event that your product arrives damaged or defective, please notify the lab directly within "48hrs" of receipt to arrange for complimentary replacement.

6. Image Delivery

   Digital photographs are delivered through a secure online gallery platform.

   Delivery timelines may very depending on the type of session or event coverage.

   RAW or unedited image files are not provided.

   The photographer carefully selects and edits the best images to ensure a high-quality final gallery.

7. Copyright & Social Media Usage

   All photographs remain the copyrighted intellectual property of Mike Norton Photography LLC and are protected under United States copyright law.

   • Ownership: Mike Norton Photography LLC retains the copyright to all images. This agreement grants the Client a non-exclusive license for personal use only ( e.g., printing for home display, sharing on personal social media).

   • Commercial Use: Images may not be sold, entered into contest, or used for commercial/business purposes without prior written consent from the Photographer.

8. Event & Race Photography

   • Photography occurs in public environments.

   • Not all participants are guaranteed individual photographs.

   • Image availability depends on timing, lighting, weather conditions, and course access.

     Teams, sponsors, or commercial organizations wishing to use photographs for marketing or promotional purposes must obtain a separate commercial license.

9. Pet behavior & Liability:

   Client acknowledges that animals may behave unpredictably. Client is solely responsible for maintaining control of their pet at all times and assumes all liability for any injury, loss, or damage caused by the pet to persons (including the Photographer) or property ( including camera equipment).

   Health & Safety: Client warrants the pet is healthy, non-aggressive, and current on all legally required vaccinations. All sessions must comply with local leash laws and park regulations.

   Limitation of Liability: Mike Norton Photography LLC is not liable for any injury, illness, loss, or death of pets during or after the session.

   Right of Termination: If the pet exhibits aggressive or unsafe behavior, the Photographer reserves the right to terminate the session immediately without a refund.

   Indemnification Clause: Client will pay for (indemnify) any legal fees or costs that incur if their pet causes a third-party injury or damages property during the shoot.

10. Limitation of Liability

    While every effort is made to provide high-quality photographic services, unforeseen circumstances may occur.

    In the unlikely event of equipment failure, data loss, memory card corruption, theft, illness, severe weather, or other circumstances beyond reasonable control, Photographer's liability is limited to the total amount paid by the Client.

    Photographer shall not be liable for indirect, incidental, or consequential damages.

11. Governing Law & Venue:

    This Agreement shall be governed by and interpreted in accordance with the laws of the State of Oregon. Any legal suit, action, or related to this Agreement shall be instituted exclusively in the State of Oregon, located in { Lane County}.

12. Acceptance of Terms:

    By booking a session, accessing a gallery, downloading images, or completing a purchase, Client acknowledges that they have read and agreed to these Terms of Sale, Service Agreement, and Privacy Policy.
